We are at cross-purposes. Can you please read my post again @ChillingOut.
I am not suggesting that ISX is running or even thinking of running a court case stating that ASX is breaching competition Rules. I am suggesting that if ISX were doing anything (and I do not maintain they are), it would be to state that ASX is in breach of ASX licence regulations because there are standards ASX must meet as stated in the Corporations Act and the Regulations when ASX has a conflict of interest.
If ASX is in competition/has a conflict of interest as is suggested in the news article, the fact that they are in competition may just be evidence to support the claim that ASX is not acting (i) in good faith;(ii) honestly and fairly and/or reasonably or providing procedural fairness. And since evidence does not have to be provided up-front, this just may be part of what is to come.
