Trade marks and patents are different things. A trade mark protects the intellectual property around a design that identifies a product or service and excludes others from using it. A Patent gives an inventor of intellectual property the right to it to the exclusion of others. Trade Marks are for designs (eg a logo, a marketing slogan or brand). Patents are for unique inventions (software, drugs, chemical, electrical or mechanical processes or devices, etc).
