Dunno about that. With Sheehy there was probably an issue of capacity to pay. Does Nuix spend time and money bankrupting a former CEO and possibly getting nothing other than another legal bill, or is it better to let sleeping dogs lie, extract a payable sum and move on? I think NUIX made a smart choice there.
The government is supposed to be a model litigant. If the court says pay up then that is what they have to do. No issue of ability to pay. My understanding is that you only get back about 60% in the Federal Court unless the costs ordered are "indemnity" costs.
