Your point is valid to a limited extent..... Continuous disclosure is not something applicable only to the trading values. It is keeping shareholders informed regardless of the ability to trade.
ISX have allowed a shot in their foot and given ASX an opportunity to say, in court, "here is evidence of non-disclosure in a timely manner"..... yet it is one only example with an absence of any other examples to support a claim that such non-disclosure is common practice or an issue relating to the initial suspension.
