I have worked for government (regulatory) agencies that have powers authorised to them (including investigational) under particular legislation, including when these powers can be delegated to those in positions below them for operational purposes.

Although the6 must comply with particular legislation, I don’t believe that ASX is operating under similar principles being a private entity (I may be wrong), so it’s very likely that ‘the ASX’ referred to in documentation may come down to simply one manager’s interpretation.

Their coming day in court will hopefully sort some of this out.
