I believe what your talking about might occur where it is a hostile takeover with no price given to shareholders. As the offer price is 4.2 cents it is illegal to pay more than that. After this offer at any time Gina can raise what she is prepared to pay but as the current offer is 4.2 cents then that is the highest she can purchase on market for as well.
