The NDA is primarily around not disclosing findings of IMEC's work before they sign off on it.
It doesn't give WDC the right to suppress 4DS from disclosing information to the market once IMEC has signed off. How could they, it's 4DS's baby, not theirs.
Note that the HGST/WDC logo is not on any of the 4DS/IMEC progress announcements. IMEC is - so to do that they have to get IMEC's sign off.
Any NDA obligation to WDC that 4DS has will be regarding confidential plans and tech that WDC have in the pipeline, that 4DS may be party to as WDC collaborate with them on 4DS RERAM development.
