Youngie, If your broker lends out "X" number of your shares which are then unsold by the shorter, then all you have is a broker who owes you "x" number of shares. The person who paid for the shares has the voting rights and whatever else goes with it. Hope we've cleared this up.
Maybe if they had to pay a Capital Gains Tax at this point it might put the brakes on the shorting.
