I dont think this smells at all. The most logical answer is usually the correct one and they are backing themselves that that the drug works and will be approved. Surely Acardia would have wanted the ROW rights so specifically carving that out only compounds my thought that the Board fully expects this to be approved and if that the case it been set-up perfectly.
