Its going to hearing, he stands to go to jail like the HIH directors if the outcome is unfavorable. Thats serious. The case is not a civil matter, its criminal. If its civil, i agree it has no bearing on bhp. But if he is proved guilty the media will have a field day with this and he will be forced to resign in disgrace and some of that mud will stick on bhp. Cant some one else take over in the mean time, or don just retire. From what i have heard this guy has an excellent case. I wouldn't mention this otherwise.
The first judge has dismissed the case, but that has been over turned on appeal and it is going to hearing. Doesn't that ring alarm bells. You don't go to hearings with no case to answer, thats what the preliminaries are for.
