There is nothing wrong with shorting a stock per se. Where an investor or investors, decide to sell short then ok.

However, they cross the legal line if they conspire to undertake this activity together and at the same time they undertake activities that constitute price manipulation. These activities are well defined and are illegal . The definition of price manipulation is extremely wide and would capture a range of practices that appear quite common in the market. The problem is that the only party that can obtain the necessary information to instigate a prosecution is ASIC.

Until ASIC decide to enforce the law and bring a test case or two, then the position is unlikely to improve.
