@mags001 there is no disjunctive there - both assertions can be true. This "report n short" strategy is not new. Often the researcher or/and the client are in places out of ASIC's reach. OM is not so I am genuinely interested to see if someone tests the illegality or otherwise of the short report. I do think your point about price manipulation is a better angle than libel.
@itzgr82balive so i'm reading that you expect discovery in the ISX vs ASX case will produce evidence that the ASX had a role in the creation of the report. I expect it was a hedge fund. I'd offer you a friendly wager, and even give you odds, if you can come up with suitable stakes.
@gregbris Of course there is zero proof. At this point there is only evidence. We have to wait for the courts to determine whether or not the evidence, on the balance of probability, constitutes proof.
