I feel that where the ASX falls down is the fact they had already decided the end result was going to be suspension of ISX. They gave no consideration to procedural fairness given the powerful contract ISX had signed.
ASX had never thought for one minute that they would be challenged in court and that an unbiased judge would determine the outcome.
My view is JK has been one step ahead of the ASX and has led them into a trap that they will find very hard to escape.
JK had the clear advantage because he orchestrated everything perfectly to reach end goal without the ASX having any idea what they were getting themselves into!
