And what is inherently wrong with a wash sale? No deceit; No laws "broken"... merely the realisation of an asset.
And who's to say what your intention was at the time of the sale? Obviously no one can know but this is the Government/ATO abusing its power as it would be foolhardy for David to take on Goliath.
