The Board announces that it will modify the decree law that regulates lithium to encourage transformation in Extremadura

The government of the Junta de Extremadura has announced on Tuesday that it will modify Decree-Law 5/2022 establishing urgent measures necessary in the regulation of the use of lithium mineral resources in Extremadura to adjust it to the legal system, and that it will do so to encourage the transformation of said mineral within the Autonomous Community. Likewise, taking into account that lithium is a strategic mineral and, according to the conclusions of the Constitutional Court, the Junta de Extremadura will require the Government of Spain, in accordance with state competences, the transformation and treatment of this mineral to be carried out within our borders. The regional government has recalled that, in the processing of this decree law, it has already been warned of the possible unconstitutionality of the rule. The Board bets that the economic, fiscal and social benefits have repercussions in Extremadura, but warns that the way to achieve this cannot be limitation or imposition, and even less regardless of the legal system. In this sense, the regional government advocates promoting stimulus measures that provide competitive advantages for companies that want to process the mineral resources of lithium in the region, and for this all the legal guarantees that provide greater security to companies are also necessary.
