Two things to take away and think about:

1. The "dispute" over IP ownership is obviously a gap in the JV agreement which may end up having to be settled in front of a judge if there is no express clause in the agreement on these matter. It may be considered to be an implied term - leave that one to the legal experts.

2. Maybe the concrete application is proving to be a lot more commercially viable and potentially valuable than most here think - otherwise why bother? And why not raise it a year ago when the first announcements came out?
