Can youreally compare the credibility of Lawlerly against Justice Davies of theFederal Court who said in the recent court case ISX vs ASX on the 29th July2020 that ISX need to providemore “particulars” to their amended SOR pertaining to how damages against theASX are “caused”. Given that Justice Davies is satisfied with those clarifying“particulars” then Justice Davies will grant ISX their latest amended SOR,including the damages claim against the ASX, and allow it to go to trial. Justice Davies of the Federal Court wants the matter betweenISX and ASX resolved ASAP. Justice Davies saw no reason to disallow ISX to pursueASX in the charge of, i.e. misleading and deceptive conduct by the ASX unders1041H of the Corporations Act and allow ISX to sue for damages. The ASX werewanting “more or better particulars” however as Justice Davies suggested thatISX should provide them she did not expect ISX to admit all their evidence asthat would be submitted in the trial. Justice Davies then said that if on the 11^th August theASX would not agree to consent to the filing of the ISX Second Further AmendedStatement of Claim then she would preside between the parties to find aresolution and allow ISX to file the Second Further Amended Claim.
