Think of it like this,
You own a logistics company, you employee a delivery driver and he does a great job, he's fast and reliable.
As part of his employment contract he must wear the company provided uniform at all times.
His mainly delivers to Qantas, Land Rover, ASICS and the Salteri family, however, he delivers in the nude. Your client base are offended by this. You inform him that his contract states he must wear his uniform.
He refuses, stating it's his right of freedom of expression
The clients tell you that he must wear his uniform or they will close their accounts. These accounts are 90% of your business.
You issue your driver with another warning, but still he refuses to wear the uniform. In the best interests of your business you have to stand him down as you cannot afford to lose your business.
He threatens unfair dismissal.
Guess the courts will decide.
