Just thought I'd make a small correction to your post regarding the standard of proof. It is not 'beyond any question of doubt' as that is an even higher standard than the criminal standard of proof of 'beyond a reasonable doubt'. Rather, the standard of proof in civil matters is 'on the balance of probabilities' which means that it is more likely than not to be the case.

Also, VMC will bear the onus of proof in relation to each of the matters that are particularised in their statement of claim and SPX will bear the onus of proof with respect to each of the matters particularised in their defence.
