Its a slippery slope, large sections of the left believe in subjective based decision making. They also believe that collective goals ideals are more important than individual principles. this leads to madness as you can justify any outcome (or even both possible outcomes) based simply on how it impacts the agreed collective ends. How can you have any society or legal system where the maximum range of outcomes is permitted with all other things remaining the same ?
They whole point of the legal system and critical thinking is to find analogies with other acts and judge each act the same on based on morally relevant facts.
Put abortion aside and look at the premises that are being used to create a criteria of decision making, you will soon realise that reductio ad absurdum always follows.
