The point is regardless of whether the product works the trial was a failure. A more highly powered study, a larger effect size, a different sample distribution etc etc could have changed that but claiming the current trial was successful is flat out wrong.
I don't think there will ever be a properly powered clinical trial, the time where potential sales could have justified one has passed. That's just my opinion though. It's unfortunately a massive case of what could have been.
