Durmaz is correct, surely Vulcan would be very close to receiving a 2 year (*not out) unexplained jail sentence, with the ASX spitballing on what to hang their hat on.
However, what has saved Vulcan and their shareholders is that they did not breach the listing rule "thou shall not be a competitor to the market operator".
We all know that listing rule grants the MO the power to deny procedural fairness and good faith.
Its a pretty important rule as it allows the operator to believe they are the regulator too.
Vulcan got lucky.
All just in my opinion of course.
