Shorts would have to close their position to realise the loss before they could include it on their balance sheets as a captial loss I believe (don't think there are different rules for traders in that sense). Then they would have to wait a minimum of a month before reloading or the tax office would consider it a wash sale and you can't claim the capital loss.
